Fishery Policies and Acts in Present Context-experiences from Coastal Bangladesh

Abstract/ Executive Summary:

This paper reviewed five policies and laws, which include the Protection and Conservation of Fish Act, 1950; The Marine Fisheries Ordinance, 1983; The Protection and Conservation of Fish Rules, 1985; National Fisheries Policy, 1998; and Coastal Zone Policy, 2005. Some sections of the policies and laws are seen to be damaging the fishing resources. It is high time for the Department of Fisheries (DoF), People's Republic of Bangladesh to review these fishery policies and laws as per stakeholders' recommendations.

Objectives:

This paper suggest for amending major clauses founded on present context that came up from series of participants' consultations, particularly with fishing communities in coastal areas in Bangladesh.

Methodology:

The data were gathered, assessed and analysed through a mixed methodology, which adapted both qualitative and quantitative strategies. A total of five policies and laws i.e. The Protection and Conservation of Fish Act, 1950 (East Bengal Act XVIII of 1950); The Marine Fisheries Ordinance, 1983; The Protection and Conservation of Fish Rules, 1985; National Fisheries Policy, 1998; and Coastal Zone Policy, 2005 were reviewed. Community Development Centre (CODEC), a non-governmental organization (NGO) that was initiated by Danish International Development Agency (DANIDA) in 1985 and dealing in coastal belt of Bangladesh, organized thirty-two consultation workshops in 2018 at Sub-District, District, and Divisional level. A total of twenty workshops were organized in coastal sub-districts where 432 fishermen representative participated at the side of different stakeholders. A complete of nine workshops was expedited in sea-facing districts wherever 434 (Male-406 and Female-28) participants attended. Divisional workshops were placed in Chittagong, Barisal, and Khulna divisions wherever 166 (Male-144 and Female-22) participants attended. In all, CBO/NGO representatives, governing body, non-public sector representatives, local government leaders, civil society representatives, fishermen, and different professional teams attended in thirty-two consultation workshops. Participants of stakeholder consultations in the main worked in teams to seek out issues of fishery policies and laws in present context mainly coinciding with lives and livelihoods of marginalized fisher folk communities. They came up with issues and suggestions in comprehensive. Stakeholders' recommendations were the outputs of thirty two consultations organized at different levels, including subdistrict, district and divisional levels. Main sections of relevant fishery policies and laws were mentioned among participants through facilitation.

Fishery policies and laws are not pro-poor, particularly for capture fishers. Issuing license for foreign fishing boat destructs fishery resources. It is necessary to ban the import or production of monofilament net. Fishermen are compelled to pass terribly crucial time throughout prohibition periods of juvenile hilsa. They are often damaged by maritime pirates. These factors taciturnly kill growth and development of fisher folk and fishery resources. Fishing communities of coastal Bangladesh are vulnerable due to completely different shocks. Their lives and livelihoods are being vulnerable by many internal and external factors. They are a Policy Victim and unnoticed segments by policy makers. The policies and laws of fishery are not poor-friendly particularly for capture fishers. In distinction, these living documents have protective interests of wealthy business folks that freshly penetrate in this sector. Moreover, these policies and laws do not sufficiently address coastal potentials and the Blue Economy, for poverty reduction and overall development. This paper suggests the government of People's Republic of Bangladesh (GoB) to address take holders' recommendations and further amends as well as implement several sections for the well-being of fishing communities.
